I was in an accident caused by someone insured by State Farm. They were rude and insisting it was not their fault. In a nutshell, there were two right turn lanes and they were in the left one. At the light, they took a sharp right, over the cross walk, leaving me nowhere to go. This person made a claim on my insurance and I sent in the dash cam video. My insurance company immediately denied their claim. Seeing it was 100% their fault. State Farm, however, is not the most technically savvy company and I struggled to get the dash cam video to them. After they finally received it, they admit it was their insured fault, but since 5 or 6 seconds before the accident, the speed showed going 38 MPH in a 35 MPH zone. At the time of the accident, my vehicle was going the appropriate speed to make the right turn. Their claim is I was 20% still likely to get into the accident because I went 3 MPH over the speed limit well before the accident occurred. The State Farm insurance adjuster conceded the dash cam speed is delayed in catching up, since after the accident my vehicle was clearly stopped and it read 11 MPH.
I have heard a lot of stories about dealing with State Farm and it seems it is true. The damage is minimal and this is simply principal at this point. I will allow it to go to arbitration to resolve and I will not accept the 80% she is offering. Video below.
